Supreme Court upholds constitutionality of state insurance tax
With CHET BROKAW Associated Press Writer PIERRE, SD (AP) The South Dakota Supreme Court upheld the constitutionality of state taxes on insurance premiums.
Metropolitan Life Insurance Co. Had argued that the South Dakota, against federal tax and the constitutional authorities of the countries treaties, because companies in South Dakota the right to deal on their own, as in other countries.
The tax rate applies to all insurance companies, but the corporations get tax breaks to the location of the home or regional offices in South Dakota.
The Supreme Court has said that the fee is constitutional because the tax rate of each company depends on the decision at the site office.
